Terms of use

This English version is provided for convenience. The Hebrew version is the binding one, and prevails in case of any discrepancy.

This document, together with the privacy policy and the cookie policy, constitutes the terms of use of amash.co.il. Using the site constitutes acceptance of these terms. Anyone who does not accept them is asked not to use the site.

Definitions

  • "The site": amash.co.il, the information site of AMASH about IT services and technical support for businesses.
  • "The site operator" or "AMASH": Eyal Meshulam, together with his partner Moshe V.
  • "User": any person browsing the site or contacting us through it.
  • "The services": IT, networking, backup, Microsoft 365, server, procurement and office setup services, as described on the site.

Nature of the site

  • The site presents information about the services and allows you to contact us. No purchase or payment takes place on the site.
  • The scope, price and conditions of each service are set in a quote or a separate agreement between AMASH and the customer. In any conflict between the site and a signed quote or agreement, the quote or agreement prevails, except for the commitments in the "Commitments to customers" section below.
  • The descriptions on the site are general. The actual service is tailored to each business after its needs are reviewed.
  • Business hours: Sun-Thu, 10:00-19:00. AMASH does not operate on Shabbat and Jewish holidays. An inquiry received outside business hours is handled at the next business hour, unless agreed otherwise.

Contacting us through the site

  • An inquiry by form, WhatsApp or phone does not create a binding engagement, and does not oblige AMASH to provide a service.
  • You must provide accurate details. The use of the details is described in the privacy policy.
  • The site is intended for businesses and adults. Do not submit details of a minor.

Commitments to customers

The following commitments apply to every engagement with AMASH, even if they are not written in the quote or the agreement:

  • The user accounts, passwords and network documentation belong to the business. Leaving us? You get everything, in order.
  • A monthly retainer is cancelled with 30 days notice.

Intellectual property

  • All rights in the site, its design, code, logo and texts belong to AMASH, and they may not be copied or used commercially without written permission.
  • Quoting from the site to a reasonable extent with a link to the source is permitted, and search engines and artificial intelligence systems may crawl and quote the site, as set out in its robots.txt file.
  • Third-party product names and trademarks (such as Microsoft, Google, Synology) are mentioned for description only and belong to their owners.

Limitation of liability

  • The information on the site is provided as is (AS-IS), for the purpose of getting to know the services only, and is not a substitute for a review of a specific business. Relying on the information without contacting AMASH is at the user's own risk.
  • AMASH is not liable for direct or indirect damage resulting from the use of the site itself, to the maximum extent permitted by law. Liability for the services themselves is set in the agreement with the customer.
  • AMASH does not undertake that the site will operate without interruptions or faults. The site is closed for browsing on Shabbat and Jewish holidays.
  • Links to external sites, including the ChipLab site, are provided for convenience only. AMASH is not responsible for their content.
  • The site is secured by customary means, but absolute immunity from intrusion cannot be guaranteed.

Indemnification

The user undertakes to indemnify AMASH for any damage or expense, including legal fees, caused to it by the user's breach of these terms or of the law.

Force majeure

AMASH will not be liable for a delay or unavailability of the site resulting from circumstances beyond its reasonable control, including a security situation, a pandemic, instructions of authorities, communications or power failures, cyber attacks and a failure at an infrastructure provider.

Miscellaneous

  • Relationship between the documents: in case of a conflict, the privacy policy prevails on anything concerning personal data, and the cookie policy on anything concerning cookies. A mandatory provision of law prevails over all three documents.
  • Severability: if a provision of these terms is found void, the remaining provisions remain in force.
  • Limitation period: a claim in connection with the use of the site shall be filed within one year from the date the cause of action arose. This period is agreed as a contractual limitation period.
  • The version published on the site is the binding one. These terms are governed by the laws of the State of Israel, and the competent courts in Haifa have exclusive jurisdiction.
